62. Amending the Companies Act to impose civil liability for minor faults, unclogging court cases
Status: The government got the Companies (Amendment) Bill, 2019 passed in the parliament to make 16 compoundable offences (out of 81 in the law) as civil defaults. It means instead of the courts, the government officers would levy penalties in the cases of minor procedural lapses (such as non-filing of financial statements or annual returns) thus lessening the burden on courts. Another Companies (Amendment) Bill was passed in September 2020 to remove the provision for imprisonment and penalties for certain offences. i ii iii
